Honest answer
Is Day 1 CPT still allowed after the 2026 DHS rule?
Numbers last checked: 2026-09-03
Short answer
Yes, and this is widely reported wrongly in both directions. DHS explicitly stated the rule does not prohibit or eliminate Day 1 CPT, and the graduate-studies provision permitting immediate CPT is unchanged. What changed is which programmes you may enrol in: from 15 September 2026, a student who completes a US programme at one level generally cannot use another programme at the same or a lower level to maintain or regain F-1 status. That closes Day 1 CPT master's programmes to anyone who already holds a US master's - not to everyone.
Who this actually affects
If you are applying for your first US master's, Day 1 CPT programmes remain open to you and the CPT rules themselves are unchanged. If you already hold a US master's and were planning a second one - commonly as a fallback after missing the H-1B lottery - that route is closed, and the only compliant onward F-1 enrolment is a doctoral programme. Programmes completed before the effective date do not count toward the restriction.
The fallback closing matters more than it sounds. A second master's was how a lot of people bought another lottery attempt. Removing it makes the first attempt more consequential and makes wage level, which drives your lottery odds, more worth optimising for.
A word on how these programmes are sold
Day 1 CPT programmes are marketed hard to Indian students, often by the same agents who earn commission for the placement. The rule change has produced a wave of content that either overstates it as a ban or dismisses it as nothing. Read the actual provision, or ask whoever is advising you to point at it.
If someone selling you a programme cannot tell you which subsection changed and which did not, that tells you what their advice is worth.
